Art. 1 – Definitions

IPIL” or “IPIL G.I.E.” or “we” refers to the Institut de la Propriété Intellectuelle Luxembourg G.I.E., having its registered office at 134, route d’Arlon, 8008 Strassen, Luxembourg and registered under the number RCS Luxembourg C115, VAT LU27864171 and whose Luxembourg training organisation approval number is 10073773/0.

The “participant” or “you” refers to the person who receives individual access to the e-learning platform, whether this access is free of charge or subject to payment.

The “e-learning platform” or “training course” refers to the online content, materials and services provided by IPIL and accessible on the website https://elearning.ipil.lu.

The “e-learning session” or “training session” refers to the period during which the participant has individual access to a training course.

Art. 2 – Registration

Registrations can be made individually online or as part of a group training offer for several participants from the same organisation.

Individual registrations are made online at https://ipil.lu, normally before the start of the chosen e-learning session. In case of late registration, IPIL reserves the right not to accept the registration depending on the duration of the chosen course and the deadline of the e-learning session. Registration requests will be processed within a few days of receipt and an invoice will be sent to the participant’s/contact’s e-mail address.

Registration is free of charge for unemployed job seekers registered with the ADEM Luxembourg, provided that they supply proof of their status to IPIL.

In the case of a group training offer, the contact person of the organisation requesting the offer will have to provide the list of participants before the beginning of the chosen e-learning session.

The list of participants should be sent to IPIL in MS Excel format and should contain the following information for each participant: Name / First name / E-mail address and the language chosen for the training session (English or French). This information is necessary to create an individual user profile for each participant.

Art. 3 – Access to courses

When registering to our e-learning platform, the participant must provide IPIL with a valid e-mail address at the time of registration. In case of an e-mail address change, the participant must change his/her profile account as soon as possible to indicate his/her new e-mail address.

IPIL will ensure uninterrupted access to the e-learning platform, except in the event of technical maintenance or exceptional incidents beyond our control. In case of access interruption, IPIL will take appropriate measures in due course to allow the participant to rapidly recover his access.

The participant will have access to the training course for the duration of the e-learning session announced at registration. The participant’s access codes will be sent to the registered e-mail address a few days before the start of the e-learning session or a few days after payment of the invoice if the e-learning session has already started. Access to the platform is maintained in order to allow the participant to register for additional modules or to follow modules offered free of charge.

The participant’s access is personal. The participant shall not share, give, license or resell his or her access to the e-learning platform to any third party not subject to these general conditions.

Art. 4 – Training Content and intellectual property

The course content, the teaching materials on IPIL’s e-learning platform and the related intellectual property rights are the exclusive property of IPIL or their respective owner. None of its content and materials may be reproduced or transferred without IPIL’s written permission. The participant may, however, print or download a copy (when this feature is permitted in the e-learning platform) for his/her own non-commercial use.

IPIL will make every reasonable effort to ensure that the content of the training courses is accurate and to correct any errors as soon as possible after being informed of them. However, IPIL shall not be liable for any inaccuracy in the course content or teaching materials contained in the training course or in the content of any other website which the participant may access from the training courses. IPIL is not responsible for the content or use of websites to which a link is provided in the course.

IPIL reserves the right to add, update, modify, change, substitute or remove without prior notice any part of the material content, occasionally and/or in particular during the period between the e-learning sessions.

Art. 5 – Conditions of sale

5.1 Payment terms

Registering for an e-learning session commits you to the immediate payment of registration fees by bank transfer after reception of the invoice. The registration fees are quoted in Euros excluding taxes. Applicable VAT rate will be charge on your invoice.

You have a withdrawal period of 14 calendar days from the date of your registration for a training course. If you register for a training course more than 14 days before the start of the e-learning session, you agree that your withdrawal period expires before the start of the e-learning session.

5.2 Cancellation of courses by the IPIL

IPIL reserves the right to cancel an e-learning session on the grounds of force majeure or on any other grounds. In this case, registration fees paid will be reimbursed and you will be notified as soon as possible.

5.3 E-learning session withdrawal

All e-learning session withdrawals must be notified in writing to the IPIL (signed letter sent by post or scanned and sent by email at training@ipil.lu).

Except for the legal withdrawal period of 14 calendar days during which IPIL commits to fully refund the registration fee, you may withdraw from a course under the following conditions:

  • without penalty if withdrawal is notified more than 14 days calendar prior to the beginning of the e-learning session
  • with a penalty of 30 €, if withdrawal is notified less than 14 calendar days prior to the beginning of the e-learning session
  • with a penalty of the entire registration fee, if withdrawal is notified on or after the e-learning session start date

In exceptional and duly justified cases (serious illness, accident, etc.), IPIL may fully reimburse registration fees even if the withdrawal notification is received less than 14 days prior to the beginning of the e-learning session or after the e-learning session start date. Decisions taken by IPIL in this matter are discretionary.

Art. 6 – Processing of personal data

IPIL collects and uses your personal data in the context of its missions. The data is processed in compliance with regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

For e-learning courses, it is necessary to create an access profile to IPIL e-learning platform. The profile created contains the basic information you provide to us when you register, including your full name and e-mail address.

When you use our e-learning platform at https://elearning.ipil.lu, information about the users, courses, activities and resources you interact with will also be stored on the platform and linked to your profile.

This information is only used to enable you to access the e-learning platform at https://elearning.ipil.lu. Statistics on your use of the https://elearning.ipil.lu website are used to improve the platform and the services provided. Profile data is not shared with any other organisation.

Your collected profile data is stored for as long as you are registered in one of our training courses at https://elearning.ipil.lu.

Your profile data will be deleted from our e-learning platform or anonymised 24 months after your last login.

You can request a copy of your personal data from your profile page on the https://elearning.ipil.lu platform at any time, as well as the definitive deletion of your profile and the deletion of all data concerning you.

Art. 7 – Applicable law and jurisdiction

Any dispute on the part of the trainee, which is not settled amicably with IPIL, shall be governed by Luxembourg law and brought before the competent courts of Luxembourg City.

IPIL may modify these terms and conditions at any time by publishing the modified terms on the website.
